Privev’s chauffeuring service offers three distinct branded offerings – Comfort, Luxury, and Safety – all provided through our fully electric fleet. The use of our services is subject to your acceptance of these terms, including our privacy policy. We value your safety and strive to provide an exceptional experience, but it is essential to note that Privev shall not be held liable for any incidents beyond our control. We reserve the right to modify or update these terms at our discretion, so we encourage you to review them regularly. 1. PHV Regulations

Pursuant to the Private Hire Vehicles (London) Act 1998 (the “1998 Act”), the Civic Government (Scotland) Act 1982 (the “1982 Act”), the Taxis Act (Northern Ireland) 2008 (the “2008 Act”), and any regulations made pursuant to such Acts, and the Local Government (Miscellaneous Provisions) Act 1976 (the “1976 Act”) and any related local government regulations pertaining to the operation of private hire vehicles (all together, the “Legislation”), a booking made by you can only be accepted by a person that holds a relevant operator’s license.

In respect of the 1998 Act, Privev Ltd. is the holder of the relevant PHV operator’s license. In respect of the 1976 Act, Privev Ltd. is the holder of the relevant PHV operator’s license in each of the district councils (other than the Metropolitan Police District and the City of London) in which it operates. In respect of the 1982 Act, Privev Ltd. is the holder of the relevant booking office licenses. In respect of the 2008 Act, Privev Ltd. is the holder of the relevant operator’s license.

2. User Registration

All information provided by the Customer must be accurate and complete through all parts of the registration process Privev Ltd. Privev Ltd. will not sell or rent your personally identifiable information, gathered as a result of filling out the registration form, to anyone.

Choosing how we use your data; – We understand that you trust us with your personal information and we are committed to ensuring you can manage the privacy and security of your personal information yourself.

With respect to the information relating to you that ends up in our possession, and recognising that it is your choice to provide us with your personally identifiable information, we commit to giving you the ability to do all of the following:

Please note that, if you have shared any information with others through social media channels, that information may remain visible, even if your account is deleted.

– You are also free to close your account through our account settings If you do so, your account will be deactivated. However, we may retain archived copies of your information as required by law or for legitimate business purposes (including to help address fraud and spam), for maximum of 12 months from the date of deactivation.

– You can always feel free to update us on your details at any point.

– You can unsubscribe from receiving marketing emails from us by clicking the “unsubscribe” link at the bottom of any email. Once you do this, you will no longer receive any emails from us.

– You can request a readable copy of the personal data we hold on you at any time. To do this, please contact us at example@example.co.uk. Please note, we are constantly reviewing how we process and protect data. Therefore, changes to our policy may occur at any time. We will endeavour to publicise any changes.

4.1 CONFIRMATION:

On our acceptance of booking a booking reference number will be issued, verbally and/or electronically by sending an email/SMS or phone message through available platforms including but not limited to Whatsapp messenger.

For all correspondence regarding the booking please quote the booking number. Privev Ltd. will accept the booking with the understanding that the customer has already read and fully accepted and agrees to the terms and conditions herein, as the option to confirm that the customer has read the terms and conditions is provided during the stage of booking.

The company will normally require a deposit to be paid of one third of the price of a return journey or half the price of a single journey. Deposits are non-refundable; however, they may be refunded at the discretion of the company with a view to special circumstances.
We may ask for your credit or debit card details as security for your booking, until the full payment has been received.

Payment may be made via credit card, debit card and/or cash. Cash and cheque payment methods are subject to prior advisement and approval by Privev Ltd.

The price of the contract or any remaining balance shall be paid to the driver as agent or employee of the company at the outset of the journey, unless a credit account facility is in place.

For Account customer, journeys will be invoiced at the completion of the agreed period. Payment is required within agreed terms of the account. Failure to finalise the account debit amount may result in a withdrawal of account facilities and transport services as well as further legal actions to recover the amount owed to the Company.

Should any extra charge be incurred we will notify you before charging.

If a booking is cancelled by the Client within 24hours from the start of the period of hire, then the Client will not be charged(this is valid for one way service).

For an event or booking request of more than 4 days, we need at least 48h notice in order to accept the cancelation and arrange for full refund .

Any deposit that has been paid for bookings will effectively be non-refundable once received if the booking is cancelled in less than 24 hours from the date and time of the requested service, unless the booking is for more than 4 days, for which the deposit will be non-refundable if the booking  is cancelled  with 48h from the date and time of the requested service, subject to review at discretion of the Company.

If a booking is cancelled by the Client within 12hours from the start of the period of hire, 50% of all deposit paid will be non-refundable. 

Any cancellation up to 6 hours will be charge at 100% of the total hire price.

If the Client does not appear at the time and place designated as the pickup point, all monies paid will be non-refundable.

6.1 No shows

“No show” means a cancellation to the customer’s service for the booked periods when the customer does not show up at the pickup location. This rule may be ignored if a later pickup time is agreed by the customer and notified to Privev Ltd.

 No show cancellations in case of:

6.1.1 Transfer Services

A No Show is only considered if the customer is not present without cancellation 60 minutes past booked pickup time at the pickup location. No shows such as this will mean a full charge of the customer’s booked service must be paid for. No extra waiting time costs will apply where possible.

Airport and train station pickups are considered as no shows when the customer has not cancelled 60 minutes prior to the booked pickup time. The amount agreed for the service the customer booked must be paid for in full in this situation; however, no extra waiting time costs will apply where possible.

6.1.2  Hourly Services

A no show is considered if the customer does not show up at all during the booked hours at the agreed pickup time and location. The service for the booking must be paid in full in this situation. The Chauffeur will wait 1 hour irrespective of the number of hours booked and then leave, considering it as a no show.

6.1.3 Company cancellation responsibility:

If chauffeurs or drivers of the Company feel that a booking cannot be made due to reasons including but not limited to sudden emergency for them, unavailability of the vehicle or unsafe condition of the vehicle, extreme weather conditions and so forth, the booking may be canceled along with a full refund.

In the event of such circumstances beyond the company’s control or any other force majore event, which include but are not limited to, strikes, riots, terrorist attacks, adverse road or weather conditions rendering the journey dangerous or impracticable, then the company can fully cancel the contract and the service to the customer by returning all money paid and without further liability or obligation to the customer.

To the extent permitted by applicable law, Privev Ltd. will not be liable to you in any way (whether such liability arises in contract (by way of indemnity or otherwise), tort (including negligence) misrepresentation, breach of statutory duty, restitution or otherwise) for: any theft or loss of your or any other person’s property in connection with the Booking Services or any booking accepted by Privev Ltd.;

7.1. any booking that has not been accepted;

7.2. any loss, damage, costs, expenses or liability suffered by anyone other than you in connection with your use of the booking service;

7.3. any losses that could not reasonably be expected to result from our negligence or breach of these Terms and Conditions;

7.4. any loss relating to your business or the business of your employer or any other person;

7.5. any loss of profits, loss of revenue, loss of opportunity, loss of business or employment (whether or not such loss could be reasonably expected to flow from our negligence or breach of these Terms and Conditions); or

7.6. any other loss, damage, costs, expenses or liability that you suffer in connection with the Booking Services, save to the extent that Privev Ltd. fails to perform its obligations to you to the standard of a diligent and professional provider of the relevant services.

Nothing in these Terms and Conditions will limit or exclude Privev Ltd.’s liability to you for personal injury or death caused directly by Privev Ltd.’s negligence.

  • Risk of damage to or loss of the Services shall pass to the customer at the time of Booking or, if the customer wrongfully fails to take the booking , the time when the Supplier has tendered booking of Services. The customer should insure the Services accordingly.
  •  Notwithstanding booking and the passing of risk in the Services or any other provision of these Conditions, the Chauffeurs Services shall not pass to the customer until the Supplier has received in cash or cleared funds payment in full for the price of the Services and all other Services and services agreed to be sold by the Supplier to the customer for which payment is then due.
9.1 Drivers Terms and Conditions

The Agreement details the provision of executive chauffeur services and/or chauffeur car service by the driver that will be performed by the driver in accordance with these terms. The driver acknowledges that full compliance with these terms is required. 

9.1.1 Agreed Rates and Procedures 

The Company will organize and advise pick up times for each customer and forward the chauffeur request details to the driver as and when required. The request details will confirm the customer’s address, destination, and agreed mileage for the trip. The chauffeur request will be sent to the driver via SMS, WhatsApp, and/or e-mail and must be responded to within 5 hours of receipt to be confirmed.

  • During the term of this Agreement, it is agreed that the driver’s status vis-a-vis the company is that of the contractor as per the contract agreed, which falls within the terms of this T&C and any agreement held between the company and the driver.
  • The relationship between contractor-based drivers, full time, part time drivers and Privev Ltd. will be that of principal and agent and nothing in this agreement shall render you an employee, worker, or partner of Privev Ltd. and you shall not hold yourself out as such.  
  • This agreement constitutes an agency agreement and not a contract of employment and accordingly you shall be fully responsible for and shall indemnify Privev Ltd.   for and in respect of: 
  • The driver agrees that they will be responsible for the payment of any tax, social security contributions or other statutory levy, or deduction which may be due in relation to any consultancy fee, commission, or expenses payable pursuant to this Agreement. 
  • The driver is responsible for any VAT payable to HMRC on any amounts payable under this Agreement. 
  • The drivers to communicate their VAT status to the Company, notifying any changes to it on a timely basis (which shall not be later than 7 days since the date of change). 
  • The driver accordingly agrees fully to indemnify and to keep fully indemnified the Company against all and any liabilities for income tax, social security contributions or other statutory levy, deduction or impost arising in respect of any fee payable under this Agreement 

Access to Privev Ltd.  Services is only permitted where you have registered. 

  • you must be at least 21 years old (or the requisite age of majority in the jurisdiction in which you are based, if older)  
  • you must hold a full DVLA, Northern Ireland, or other EEA stated driving licence that is at least three years old  
  • you must have the right to live and work in the UK. 
  • you must hold a private hire driver licence and you must own a vehicle with an appropriate private hire vehicle licence. 
  • All drivers must be of smart appearance. Suit, tie, shirt, and shoes are the required dress under this agreement. 
  • drivers must not use handheld telephones whilst driving. 
  • drivers must not smoke in the presence of customer. 
  • drivers must ensure upon arrival at a collection point that the customer is the correct individual. 
  • drivers must assist customer with luggage and be always polite. 
  • Name boards – drivers must carry iPad (plane name board) when meeting customer for any journey booked by the company. 
  • The supplier and its drivers must not solicit business from any customer, first introduced to them by the I London VIP Chauffeur Company this will prosecuted and reported to TFL. 
  • drivers should ensure that they are at the pickup point atleast 15 minutes prior to their allotted pickup time. 

9.2: Vehicle terms and conditions:

Unless specified as a continuous hire the hirer cannot assume that the vehicle will remain at the destination or be available for their use in the interim period between arrival and departure

The company reserves the right to substitute another vehicle, including those of another operator, for all or part of hiring provided they are of equal or greater value.

A vehicle will be provided with enough seating capacity for the number of passengers booked under no circumstances will the chauffeur permit the authorized seating capacity to be exceeded.

Privev Ltd. warrants maintaining its vehicles in good order in accordance with the manufacturer’s recommendations.

9.3 Confidentiality 

The driver will keep confidential all matters pertaining to this agreement and the business of the Company and will not discuss or divulge to any third party (including customer) any information which is obtained by reason of this Agreement and/or the relationship with the Company. 

9.4 Insurance / Licenses 

The supplier must ensure that all vehicles allocated to transfers booked by the company, have valid Private Hire Licenses and appropriate insurance. drivers and their vehicles must always be compliant with all laws and regulations. The Company require a copy of all documents, registrations, licenses, policies etc. pertaining to the driver complying as foresaid. 

9.5 customer Service 

The Company is committed to providing a First-Class service to all its customer. Accordingly, all drivers will always employ the highest standards of service possible. The Company reserves the right to withhold payment in the case of serious complaints received from customer about a driver. 

9.6 Vehicles 

All vehicles will be a maximum of 10 years old, be air-conditioned and carry hands free mobile which the driver can use legally whilst the vehicle is in motion. All vehicles provided must be full electric.  

9.7 Entire Agreement 

These Terms and Conditions represent the entire understanding relating to the use of the Website and supersede all other statements, representations, or warranties (whether written, made by email or oral) made by us. 

Nothing in these Terms and Conditions shall affect the liability of either party in respect of any misrepresentation, warranty, or condition that it makes fraudulently. 

We are very proud of our high standards of customer service.

We are under a legal duty to provide the booking services with reasonable care and skill. We do not charge for our services until the booking is confirmed and accepted mutually by both end, which can be cancelled and/or amended within the allowed time without any charges, otherwise charges will be applied as per company policy and the refund policy mentioned above.

These terms are governed by English & Welsh law and you can bring legal proceedings in respect of the booking services in the English & Welsh courts. If you live in Scotland you can bring legal proceedings in respect of the booking services in either the Scottish or the English & Welsh courts. If you live in Northern Ireland you can bring legal proceedings in respect of the booking services in either the Northern Irish or the English & Welsh courts.

Alternative dispute resolution is a process where an independent body considers the facts of a dispute and seeks to resolve it, without you having to go to court. If you are not happy with how we have handled any complaint, please note that disputes may be submitted for online resolution to the European Commission Online Dispute Resolution platform.

 Chauffeurs:

All our chauffeurs are DBS checked. The hours of operations for the chauffeur are regulated by the law according to an EU directive.

Neither the hirer nor passenger shall delay or interrupt the journey in such a way that the chauffeur is breaching the law. If such a breach occurs the hirer is responsible for additional costs incurred.

 Passengers Conduct:

The chauffeur reserves the right to refuse any passenger/s that are deemed to be under influence of alcohol or drugs, not respecting the driver and vehicle policy and may be deemed to be a danger or nuisance to vehicles, passengers or other persons. No refund or compensation will be made under these circumstances. The company may request the assistance of the police to remove the offenders to protect the chauffeurs, passengers, or vehicles.

The company will provide a clean and tidy vehicle, in respect the hirer is obliged to leave the vehicle in the standard it was received. Costs of repair, reinstatement or cleaning will be borne by the hirer. If necessary, a cleaning charge will be forwarded to the hirer; please note cleaning such as vomiting is subcontracted to a third-party company. This is very expensive

Where the hire is to a sporting event, the hirer should be aware of legal requirements relating to the carrying of alcohol and the conditions of entry. The company can provide details of restrictions upon request.

All passengers are required by law to use seat belts provided. Our chauffeurs will not commence the journey until all legal requirements are being complied with.

Children:

By law small children require additional appropriate restraints. We neither provide nor assist in the fitting of child seats or restraints.

It is the passengers’ entire responsibility to make sure any children in his/her care are properly secured.

Please advise the booking office when children are traveling.

Animals:

Animals shall not travel without written permission from Privev Ltd.

Accommodation:

Should the chauffeur be required to travel and spend overnight in accommodation the costs will be subject to an accommodation and subsistence allowance according to the quotation.

Departure Time:

Departure and journey times may be suggested after making allowances for the day of travel and traffic conditions at these times. Privev Ltd.will not be responsible for clients insistence for any variation to the recommended times or delay to agreed departure time, which may result in missed flights, connections or meetings or any other loss. The customer shall provide shall the Privev Ltd. with notification of such request and allow enough time as per judgement of the customer only, during the time of booking for flight or time sensitive journeys and other journeys that require a fixed arrival or departure time.

Any delay during a journey caused by the passenger is solely their own responsibility. The chauffeur must not be asked to speed or drive recklessly to make up time.

Disorderly Behaviour:

The chauffeur reserves the right to refuse any passenger/s that are deemed to be under influence of alcohol or drugs and that maybe deemed to be a danger or nuisance to property, passengers or other persons. No refund or compensation will be made under these circumstances. The company may request the assistance of the police to remove the offenders to protect the chauffeurs, passengers or property.

14.8 Food or Drink:

Food & drink (particularly alcoholic beverages) may not be consumed on the vehicle without prior written consent.

Our chauffeurs retain the right to refuse passengers from eating or drinking in the vehicle other than the mineral water provided.

Should any damage occur because of the passenger’s actions to a vehicle or property, the full costs of repair and loss of income will be invoiced.

In the event of vomiting in the vehicle the cost of cleaning and loss of income will be invoiced.

Gratuities:

Tipping or gratuities are purely at the passenger’s discretion and may be paid directly to the driver on the day. If you wish to have the gratuity as part of the tax invoice, please advise the booking office prior to the journey taking place.

Law:

The Law in England and Wales applies to all contracts, and the terms and conditions form part of the contract whether made verbally or in writing.

Insurance:

Our company, vehicles and chauffeurs are fully insured for passenger or third party claims under English law, however any property carried during the services by the Company to the customer will be at the customer’s own risk. Privev Ltd. will not be held responsible for loss or damage to property.

Liabilities & Delays:

Every effort will be made to get you to your destination on time. Privev Ltd. is not liable for any loss due to delays caused by unforeseen circumstances such as but not limited to – mechanical breakdown, unpredictable incidents, traffic jams, road works, road closures, diversions, extreme weather conditions, collisions caused by other parties or terrorist attacks. The company may cancel all services and may refund in the event of circumstances beyond our control.

Our Chauffeurs will choose a route using their experience & knowledge of local conditions. They will be happy to accept an alternative route as requested by passengers, however should this result in extra miles or time; an extra charge may be levied.

In the instance of last-minute mechanical breakdown, exceptional traffic difficulties, incidents, accidents or any events beyond our control, we will endeavour to supply another vehicle from our extensive range of fleet vehicles and contact base.

Licensing:

All vehicles and chauffeurs are fully insured. They are licensed by the Public Carriage Office (PCO) London. For any issues regarding the license, operator and or driver in the first instance please contact this office or alternatively please contact Transport for London Taxi & Private Hire

Lost Property:

Our Chauffeurs will check for any items left by their passengers. Any items left by a passenger and missed by our driver will be returned to the office. The items will be logged and secured in accordance with PCO regulations.

The owner of the property will be notified, where possible and returned to a location of your choice however we may recover reasonable costs for doing so. After 30 days uncollected items or untraceable owners all items will be passed onto the police.

 Luggage:

Vehicles are subject to restrictions on carrying luggage for safety reasons. The hirer accepts that the chauffeur shall be the sole judge as to whether or what extent passenger’s property is carried.
Privev Ltd. accepts personal property of the hirer and their passengers on the understanding that it will take all reasonable steps to avoid loss or damage.

The hirer should notify the company or the driver if items of exceptional value are to be carried. It is the hirer’s responsibility to minimize the risk of loss when property is left unattended. Please notify us at the time of booking should you require us to carry excess or oversized luggage.

 Parking:

We reserve the right to refuse to wait in un-designated areas or where a fine could be imposed. In circumstances where the chauffeur is requested to wait in one of these areas, then the hirer of the vehicle will be completely responsible for any parking fines incurred.

All our chauffeurs abide by the current laws and regulations governing speed restrictions and will not break these. All parking and toll fees will chargeable to the customer.

Smoking:

In accordance with the 2007 ban which includes smoking on vehicles which serve the public the company operates a strictly no smoking policy in all vehicles. This includes vaping and all forms of electronic smoking.
